Terms of Service

By booking, approving a quote, paying an invoice or using services from WatchDog Drone & Real Estate Photography (“WatchDog”), the client agrees to these terms.

Services

WatchDog will provide the photography, aerial imagery, video, floor plans, virtual staging or related real estate media selected in the client’s order. The booking confirmation and invoice identify the services included.

Property access and preparation

The client is responsible for obtaining permission to enter and photograph the property, providing accurate access instructions and ensuring that occupants, pets, vehicles, valuables and personal items are properly secured. The property must be ready at the scheduled arrival time. WatchDog is not responsible for cleaning, staging, moving furniture or handling personal property.

Scheduling, cancellation and return visits

Appointments cancelled or rescheduled with less than 24 hours’ notice may be subject to a fee. A return-trip fee may apply if the photographer cannot access the property, the property is not reasonably ready or unsafe conditions prevent completion of the services.

Weather and drone operations

Drone services are subject to weather, airspace restrictions, property conditions, equipment limitations and applicable FAA requirements. The remote pilot has sole authority to determine whether a flight can be completed safely and legally. Drone services may be postponed, modified or cancelled when conditions or required authorizations do not permit the planned operation.

Image selection, editing and accuracy

WatchDog will use professional judgment when selecting, processing and delivering media. Unless agreed in writing, unedited files, RAW files, rejected images and working project files are not included. Images may be adjusted for exposure, color, perspective and presentation. Professional touch-ups may include minor cosmetic cleanup and image corrections, but WatchDog will not intentionally conceal a material defect or misrepresent a property’s permanent physical condition. Virtual staging and material digital alterations should be disclosed when required by an MLS, advertising platform or applicable rule.

Payment and delivery

A 50% deposit is required at booking to reserve the appointment. A requested date and time are not secured until WatchDog confirms availability and receives the deposit. The remaining balance is due according to the final invoice and must be paid before delivery or release of usage rights, unless WatchDog agrees otherwise in writing. WatchDog may withhold delivery, download access and usage rights until payment is received in full. Estimated delivery times may be affected by weather, access, requested revisions, technical issues, emergencies or circumstances outside WatchDog’s reasonable control. Clients are responsible for downloading and safely storing delivered files.

Limitation of liability

To the maximum extent permitted by law, WatchDog’s total liability arising from a service will not exceed the amount paid for that specific service. WatchDog is not responsible for indirect, incidental, consequential or special damages, including lost listings, commissions, profits, marketing delays, MLS issues or third-party claims.

Client responsibility and indemnification

The client agrees to be responsible for claims arising from unauthorized property access, inaccurate information supplied by the client, unlawful or misleading use of delivered media, failure to disclose material digital alterations or use of media beyond the license granted below.

Electronic acceptance and governing law

Placing an order, approving a quote, paying an invoice, signing electronically or selecting an acceptance checkbox constitutes agreement to these terms. These terms are governed by Florida law. Any dispute will be handled in Palm Beach County, Florida, unless the parties agree otherwise in writing.

Promotional Offer Terms

First-time client offer

Eligible first-time WatchDog real estate photography clients may receive 20% off the base price of one Standard Listing Package. The offer applies to a client’s first completed booking only and does not apply to add-ons, premium or custom packages, travel charges, taxes, third-party fees or other expenses. The offer cannot be combined with a referral reward or another promotion.

Referral reward

When an eligible new client identifies an existing WatchDog client as the referrer at booking, the new client may receive $50 off the base price of their first eligible real estate photography booking. The referrer may receive a $50 account credit after the new client’s first shoot is completed and paid in full. A referral must be disclosed before the new client’s invoice is finalized.

Referral credits have no cash value, are nontransferable, cannot be combined with another promotion and may be applied only to a future eligible WatchDog service. One referral reward is available per new client. WatchDog may verify eligibility and may modify or discontinue promotional offers prospectively. The 50% booking deposit is calculated after any confirmed discount is applied.

Copyright & Image Licensing

Unless otherwise agreed in writing, WatchDog retains the copyright to all photographs, video, aerial imagery and other creative media it produces.

After payment is received in full, the client receives a limited, nonexclusive, nontransferable license to use delivered media to market the photographed property during the active listing or rental-marketing period. Permitted uses include the MLS, vacation-rental platforms, listing advertisements, social media, brochures, agent or property-manager marketing, and other materials directly connected to marketing that property.

Media may not be sold, transferred, sublicensed or supplied for reuse by another agent, homeowner, builder, vendor, publication or third party without written permission from WatchDog. Substantial alterations are also prohibited unless authorized in writing.

Unless the client requests otherwise in writing before the appointment, WatchDog may use selected media in its portfolio, website, social media, advertising, competitions and educational materials. Private access information and client security details will not be published.

Privacy Policy

WatchDog may collect contact details, property information, appointment instructions, communications, service selections and transaction information needed to provide services and operate the business.

This information may be used to schedule appointments, complete and deliver services, process payments, respond to inquiries, maintain business records and communicate about an order. Information may be shared with providers that support editing, delivery, scheduling, communications and payment processing when reasonably necessary to complete the requested service.

WatchDog does not sell client contact information. Clients should avoid sending alarm codes, lockbox information or other sensitive access details through public website forms or social media.
